1. Acceptance

By using this website you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the site.

2. Who we are

This site is operated by Mercy Gate Foundation, a California nonprofit public benefit corporation recognized by the IRS as a 501(c)(3) public charity (EIN [XX-XXXXXXX]), registered with the California Attorney General’s Registry of Charities and Fundraisers. “Mercy Gate” is the public name for a federation that also includes Mercy Gate Medical PC (California) and Mercy Gate Medical PC (Oregon), professional corporations in formation. No clinical services are offered through this site.

3. Use of the site

You may use the site for lawful, personal, and non-commercial purposes. You agree not to interfere with its operation, attempt unauthorized access, scrape donor or contact data, submit false information, or use automated means to submit forms. We may suspend access for misuse.

4. Donations

  • Donations are made to Mercy Gate Foundation for general support and are used in accordance with the Board’s charitable mission.
  • Contributions are tax-deductible to the extent permitted by law. No goods or services are provided in exchange for a contribution. Consult your tax advisor.
  • Payments are processed by [processor] under its own terms; the Foundation does not store card or bank data.
  • Gifts are generally final. If a gift was made in error or in the wrong amount, contact giving@[domain] within 30 days and we will work with you to correct it.
  • Tribute gifts: you confirm you have a reasonable basis to name the honoree and to provide any notification email. We never disclose the amount to the honoree or family.
  • Solicitations are currently made in California only; the Foundation will register in other states before actively soliciting there.

5. Recurring gifts

By choosing a recurring gift you authorize the Foundation, through its processor, to charge your chosen payment method at the frequency you selected, starting on the date you selected, until you pause or cancel. You may pause or cancel at any time from the link in any receipt, without contacting us; changes take effect before the next scheduled charge.

6. Content and intellectual property

The text, marks, and design of this site belong to Mercy Gate Foundation or its licensors. The name “Mercy Gate” and associated marks may not be used without written permission. You may quote brief excerpts with attribution for non-commercial purposes.

Certain institutional documents - including the Covenant and the Foundation’s ethics and governance instruments - are described but not published on this site. Descriptions here are summaries and do not constitute the documents themselves.

8. No medical, legal, or tax advice

Nothing on this site is medical advice, and no physician-patient relationship is created by using it. If you have a medical emergency, call 911. Planned-giving information is general and is not legal or tax advice; consult your own advisors.

9. Disclaimers

The site is provided “as is” and “as available.” We work to keep it accurate and accessible but do not warrant that it will be error-free or uninterrupted. Statements about institutions in formation describe intentions and commitments as of the effective date and are not guarantees of specific dates or outcomes.

10. Limitation of liability

To the fullest extent permitted by law, Mercy Gate Foundation and its directors, officers, and volunteers are not liable for indirect, incidental, or consequential damages arising from use of the site. Nothing in these Terms limits liability that cannot be limited under California law.

11. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in [county], California.
